I am pleasantly surprised that judge Cannon had the balls (metaphorically speaking) to throw out Jack Smith’s case because he was an improperly appointed special counsel per the appointments clause in the Constitution. The question is what happens next? If Jack Smith appeals to the appeals court and they likely (based on their past decisions) overrule her that would set up an appeal to SCOTUS. Clarence Thomas has already communicated his hostility toward Jack Smith improper appointment. Unlike judge cannon’s ruling which only applied to her case if the Supreme Court weighs in on that they would likely decide that special counsel’s not correctly appointed/confirmed are invalid. That would also toss out the Jack Smith Washington DC case. The ball is in Smith’s court on rather or not to appeal Cannon’s dismissal of the Florida case.
I suspect he will appeal. And then an appeal to the Supreme Court. The Supreme Court might refer back to the Appeals Court for an en banc hearing or they might want to expedite because of the looming election. If the SCOTUS hears the case, I expect they will affirm Judge Cannon’s ruling.
If he (Smith) doesn’t appeal, I suspect Trump’s attorneys will file an immediate motion to dismiss in the DC court based on the Florida court ruling. They (DC) can reject the motion but it will be a grounds for appeal.
“Special counsel Jack Smith to appeal Trump classified documents case
A federal judge in Florida dismissed the classified documents case against former President Donald Trump on Monday”
The Justice Department has authorized Special counsel Jack Smith to appeal U.S. District Judge Aileen Cannon’s Monday ruling dismissing the classified records case against former President Trump, Fox News Digital has learned.
“The dismissal of the case deviates from the uniform conclusion of all previous courts to have considered the issue that the Attorney General is statutorily authorized to appoint a Special Counsel. The Justice Department has authorized the Special Counsel to appeal the court’s order,” Peter Carr, spokesperson for Smith’s office, told Fox News Digital.”
Democrats preparing to riot at the RNC. There will be no lowering of the temperature. They will escalate.

I remember when Sarah Palin was eviscerated and blamed because Gabby Giffords got shot by a lefty lunatic. Why? Because Palin posted a graphic showing Gifford’s DISTRICT in crosshairs.
Then Joe Biden says “It’s time to put Donald Trump in the Bullseye” two days before he’s shot, and the media that eviscerated Palin is totally silent.
I think the Democrats are serious about wanting to lower the temperature. However, only in one direction: in their own favor.
Also, I’d like to add that it’s not only Trump who’s the victim of lawfare. Democrats are doing it to a lot of people who go against them or their pet causes. The reprehensible persecution of Rand is one example.
…begins with ending the lawfare against Trump and his supporters.
And so it has.
“And so it has.”
