Well, it wouldn’t be good optics for Newsom to give up too easily. One might get the idea that he didn’t take the law seriously when he signed it and/or knew that it was unconstitutional nonsense. But on the other hand, he won’t get political points out of dragging the case all the way to the Supreme Court. I think it’ll get that far only if he or the Party want more out of it than press.
One legal route that might be tried at this initial level is to claim that Babylon Bee doesn’t have standing because they wouldn’t be affected by the law. You know the “Can’t sue until we crack down on you.”
