  1. Who is planning on doing something over the next few years that would cause any issues with treaty interpretations? Would tugs or commercial stations be an issue or would lunar activities?

    The first two don’t seem to run afoul. Lunar activities could but they will be taking place in coordination/cooperation with government efforts, so that lends them an air of legitimacy right off.

    Does anyone think the regulations regarding that Swarm launch are a case of needless regulations or treaty entanglements?

    1. There’s been talk of legislation to address a so-called regulatory gap for new space activities. Tugs, satellite servicing, and lunar activities have all raised the question of whether they need to be authorized and continuously supervised under Article VI of the Outer Space Treaty. As a legal matter, unless Congress says they do, they don’t.
