That’s right. This country is still asleep. Still trying to win a ‘fair and balanced’ fight. This fight is not fair. This fight is not balanced. The progressives, the terrorists, etc. are relentless.
We win one battle, pat ourselves on the back and ignore losing ten other battles. There is absolutely no way Kagan should be allowed on the supreme court, but that wise latina shouldn’t have been either. Taxpayer money shouldn’t be used as a political slush fund. They do it out in the open and they don’t get called on it and it never stops.

I’d like to ask her about the role of SCOTUS policy making into the contentiousness of these hearings. The Judicial Branch isn’t supposed to be a political branch. Political branches set and carry out policy and are accountable to the people through elections. Ordinarily, the approval of judges and justices would look at competency, experience, knowledge of the law, etc. But with SCOTUS having made itself a policy body not accountable to voters, the only time the nation has input is during confirmation hearings which then turn into full scale political battles, complete with oppo research, mudslinging and demonization.
If she thinks Borking is a good thing, she ought to be disqualified for that alone.
The problem is, unless they are a total joke like Harriet Meyers, all they have to do is lie and give the right answers, as Sotomayor demonstrated. They could use a bit more bork in the process, perhaps without the circus, but I’d even take the circus if they had some backbone to go with it.
Nine people decide the fate of hundreds of millions. I want them put through the fire and if they can’t handled it… good, then we’ve found out what we need to know. If that means, political operatives lie and smear, well, those guys are mostly lawyers, they should be able to deal with that.
