A federal appeals court has ruled that a takings lawsuit against the CDC on the eviction moratorium during covid can move forward.
Unfortunately, if the landlords win, it will be the taxpayers on the hook for this, not the bureaucrats responsible, so it’s not clear how this will create the proper disincentives.
The dissenting judge certainly seems like a dyk, concerned that the government might have to pay for a taking that wasn’t legitimate.
Yeah, that seems like the point.
The crazy thing this exposes is all the government agents who get upset at being liable for their actions.
This could cause the government problems. Good. Let it. I’d like to see personal liability for some of the stuff the government does, because in the end that’s what it’s going to eventually take to get them to stop doing it.
Since this case will probably stretch into next year at the soonest, a Trump administration could issue an executive order mandating that any settlement for cases like this come from the offending agency’s budget. If that means the agency has to fire people to pay the settlement, oh well…
