This will go absolutely nowhere and will remain strictly he-said, she-said until a legally “disinterested” 3rd party is brought in. In other words, I see a start-up opportunity! Public Notary vis-a-vis a SmartPhone app! In other words a sexual non-aggression / permission indemnification document that must be publicly signed and notarized, before *any* legal sex can occur. It can all be done through the convenience of a SmartPhone! Quickly handled after dinner & movie but before the “drop-off” @home with just a push of a button and letting two SmartPhones scan each other’s box grids. Rand you of all people would be the last to oppose the ramp up of a new business! Besides, what do we have to fear from NSA collection of our meta-data?
In the next generation of this tech with wearables and wifi implants, just skip the sex act altogether and have two SmartPhone scan each other’s box grids and presto!, a wifi command is sent to release oxytocin directly through your implant into your brain. Done!

Still, I guess there’s another alternative. We could create something called a ‘marriage contract’, where sex would be illegal before ‘marriage’, but the ‘marriage contract’ would legalize it between the two people who sign.
