That’s what a law professor claims the Minnesota recount was. There certainly did seem to be a lot of political gamesmanship going on, and (as usual) the Republicans didn’t play the game very well.

I think it is a stretch to suggest that do-over is required. But otherwise, I agree with the editorial along the lines that votes are being counted in ways that not every voter was offered.
As with any measurement there is a margin of error. An election that is this close is within the margin of error. You can’t really say with confidence that Franken or Coleman was the chocie of the people of Minnesota. The appropriate thing would be to have a “do-over” election (in run-off style to get rid of some of the noise) whenever the margin in an election is below some critical level.
Of course, a “do-over” option should be written in the law and the criteria set down before the election. Making one up by judicial fiat is as troubling as the current mess in Minnesota.
Lawrence Livermore Laboratories has discovered the heaviest element yet known to science.
The new element, Governmentium (Gv), has one neutron, 25 assistant neutrons, 88 deputy neutrons, and 198 assistant deputy neutrons, giving it an atomic mass of 312.
These 312 particles are held together by forces called morons, which are surrounded by vast quantities of lepton-like particles called peons.
Since Governmentium has no electrons, it is inert; however, it can be detected, because it impedes every reaction with which it comes into contact. A tiny amount of Governmentium can cause a reaction that would normally take less than a second, to take from four days to four years to complete.
Governmentium has a normal half-life of 2- 6 years; It does not decay, but instead undergoes a reorganization in which a portion of the assistant neutrons and deputy neutrons exchange places.
In fact, Governmentium’s mass will actually increase over time, since each reorganization will cause more morons to become neutrons, forming isodopes.
This characteristic of moron promotion leads some scientists to believe that Governmentium is formed whenever morons reach a critical concentration. This hypothetical quantity is referred to as critical morass.
When catalyzed with money, Governmentium becomes Administratium, an element that radiates just as much energy as Governmentium since it has half as many peons but twice as many morons

I was referring primarily to your last paragraph, that I see no means of forcing a do-over other than judicial fiat. However, I do appreciate your argument. I agree that with all the errors that have been identified, the margin of victory can easily be swayed by just one those errors. When that is the case, a do-over sounds like a good recourse, but it ought to be codified prior to the election.
